Terms and Conditions

These terms are the agreement between you and Two Dudes Digital Design, LLC, doing business as Tetra Craft ("Tetra Craft," "we," "us"). By placing an order, you agree to them. If you don't agree, please don't order.

In short

• We build your website from the template you choose and aim to launch it within one week of getting everything we need from you.
• You pay a one-time setup fee and a monthly fee that covers hosting, security, backups, and support.
• The monthly service has a 6-month minimum. After that, you can cancel anytime.
• Once we start building, fees are non-refundable.
• You own your site's content, and you can move your site to another host if you cancel.

1. What we provide

We build and launch a website for your business using the plan and template you choose. We then host and support it through our managed website service. Your plan's details are on our Pricing page, and we may improve our service over time.

2. Fees and payment

• Setup fee: A one-time fee for your plan, due when you order.
• Monthly fee: Your first month is due when you order. Billing then continues monthly.
• Prices: Current prices are shown at checkout and on our Pricing page, in US dollars, plus any applicable taxes.
• Payment: We charge the payment method you provide. You authorize us to charge it for the fees due under these terms.
• Missed payments: If a payment fails, we'll contact you. If it's still unpaid after 10 days, we may pause your site. After 30 days, we may take it offline and delete its files.

The monthly service has a minimum term (see Section 7).

3. Timeline and launch

We aim to launch your website within one week of receiving your payment, your completed setup form, and the content we need. If we're waiting on you, launch moves back by the same amount of time. We're not responsible for delays outside our control.

We build within the template you chose and share the site with you for review. Once you approve it, we launch it and consider the work accepted.

4. Your part

To keep things moving, you agree to:

• Give us accurate information and respond to our requests promptly.
• Give us only text, images, and logos you have the right to use.
• Review your site and tell us about any problems before you approve it.
• Use your website lawfully. We may remove content that is illegal, deceptive, or harmful.

If you don't have photos or text, we can create or find what you need. Stock media we choose stays under its owner's license (see Section 9).

5. Changes outside your template

Requests that stay within your template are included. If you want something outside it, such as a custom layout, added features, or pages the template doesn't support, we'll give you a price first and only start after you approve it.

6. Hosting and support

Your monthly fee covers hosting, security, updates, backups, maintenance, and support.

Support means help with your site after launch: small content changes to your existing pages (editing text, swapping photos, updating hours or contact details) and answers to your questions. New pages, redesigns, custom features, and changes outside your template are priced separately, as described in Section 5.

Backups run daily. We work to keep your site running, but no host can promise it will always be available or error-free, and we occasionally schedule brief maintenance.

7. Minimum term and cancellation

• Minimum term: 6 months, starting when you pay your first monthly fee.
• After the minimum term: Cancel anytime by emailing support@tetracraft.co. It takes effect at the end of your billing month, with no cancellation fee.
• Before the minimum term ends: You can cancel, but the remaining monthly fees for the term are still due. Alternative: a flat early-termination fee of $500.
• Taking your site with you: You can transfer your site to another host yourself. Alternative: you may pay us to transfer your site at our rate of $100/hour. Section 9 explains what transfers.
• After you cancel: Your site goes offline when your paid period ends. We may delete your site files 30 days later, so please transfer your site before then.
• If we end the service: We may end it right away if you seriously breach these terms, stop paying, or use your site unlawfully. If we end it for any other reason, we'll give you 30 days' written notice and you won't owe the rest of the minimum term.

8. Refunds

If you cancel before we start building, we'll refund your setup fee and first month. We start building when we begin work on your site after receiving your payment and completed setup form. After that, fees are non-refundable.

9. Ownership and transfers

• Your content: When your setup fee is paid in full, you own your site's text, pages, and graphics, plus your business name, logos, and any materials you supplied.
• Third-party materials: Software, themes, plugins, fonts, and stock media belong to their licensors. They're licensed for use on your site and don't transfer to you.
• Our templates and code: These remain ours. You can keep using them as part of your website, including on another host, but not resell or distribute them on their own.
• Portfolio: We may show your site as an example of our work unless you ask us in writing not to.
• Domain names: If we register a domain for you, you own it once we're paid in full.
• Transferring: After you cancel, you can move your site to another host yourself. You're responsible for your own licenses, tools, and keys for any premium features, since we can't transfer ours. We can help with the move for $100/hour.
• Unpaid balances: We may hold site files and domain transfers until any unpaid balance is paid.

10. Limits of our responsibility

We build professional, search-friendly websites, but we can't guarantee search rankings, traffic, leads, sales, or any other business result. Except as stated in these terms, we make no warranties, to the extent the law allows.

We're not liable for lost profits, lost data, or other indirect damages. Our total liability for any claim is limited to what you paid us in the [12] months before it arose.

11. Intellectual property claims

We won't knowingly give you work that infringes anyone's rights, and you won't give us materials that do. If either of us learns of a possible problem, we'll tell the other in writing. If a third party makes a claim because one of us broke this promise, that side covers the other's reasonable losses and legal fees.

12. Privacy

We handle personal information according to our Privacy Policy.

13. Changes to these terms

We may update these terms. Changes apply going forward once we post them here with a new "Last updated" date, and we'll email you about material changes. If you keep using our service afterward, you accept them.

14. Contact and notices

Send questions and legal notices to support@tetracraft.co. We'll send notices to the email on your account, and they count as delivered the day we send them.

15. Legal terms

These terms are governed by Washington law, without regard to conflict-of-law rules. Disputes will be handled in the courts of Spokane County, Washington. If any part is found unenforceable, the rest stays in effect. These terms are our complete agreement and replace any earlier discussions or promises, and they can be changed only as described in Section 13 or in writing signed by both of us.
